UPDATE: Norfolk security guard charged with rape

UPDATE: The case against Michael Spearman will move forward. After hearing testimony from the ODU student, a judge ruled today that the case can be presented to the grand jury. The Commonwealth s Attorney withdrew two sodomy charges, but Spearman still faces the rape charge, officials say.

Norfolk, Va.

A security guard charged with sexually assaulting an ODU student is due in court today.

This past April, police charged 29-year-old Michael Spearman with rape.

They say he was a security guard at the District apartment complex near the Old Dominion University campus.

They say he was on duty when it happened.

Michael Spearman faces a rape charge, as well as two counts of forcible sodomy.

Spearman s family says it s not true.

They spoke only to NewsChannel 3 shortly after ODU police arrested him.

What went through your mind at first?

It can t be true. Why would somebody say that about a person who wouldn t hurt anyone?

The mother of Spearman s five children defended her fiance.

He s a great person. Anybody who s ever met him, you know he s sweet, he s charming, he s giving.

Nah, he ain t do that, that s not him.

That s not his character.
